1
Agreement and authority
By using this website, submitting a request, or affirmatively enrolling a phone number for Virbula Oncall SMS or voice notifications, you agree to these terms. If you act for an organization, you represent that you are authorized to act for it. If you do not agree, do not use the affected feature.
Our Privacy Policy explains how personal data is handled. A signed customer agreement, data-processing agreement, order form, or product license controls if it conflicts with these website terms.
2
Permitted website use
You may use the website for lawful business evaluation, documentation, sales, support, and customer communications. You may not interfere with the website, probe or bypass security, submit malicious content, impersonate another person, misuse forms, harvest data, or use the website in violation of law or another party’s rights.
Product descriptions, roadmaps, comparisons, pricing, and demo information may change. Website content is informational and is not a binding service commitment unless incorporated into a signed agreement.
3
Virbula Oncall product terms
Use of Virbula Oncall software, Virbula Cloud, a self-hosted deployment, or the mobile app is governed by the applicable customer agreement, order, license, and end user terms. The customer organization is responsible for administering its users, teams, services, schedules, rotations, escalation policies, integrations, notification channels, and retention.
4
Operational SMS and voice notification terms
A user may separately opt in to receive automated operational notifications at a phone number added to Virbula Oncall. Notifications may include alert summaries, priorities, service names, acknowledgement or escalation instructions, verification codes, status updates, and test messages. They are transactional on-call communications, not marketing messages.
Consent and message frequency
By checking the phone-contact consent box, you confirm that you are the user of the number or have documented authority and the number user’s prior express consent. You authorize the customer’s Virbula Oncall deployment and its communications providers to send recurring automated SMS messages and/or automated or prerecorded voice calls for the selected contact method. Consent applies only to this operational subject matter and the phone number entered.
Message and call frequency varies based on active alerts, verification activity, tests, escalation policies, and the user’s notification rules. During an incident, multiple messages or calls may be sent. Standard message and data rates may apply. Consent is not a condition of purchasing Virbula software, but declining consent means that phone number cannot be used as an SMS or voice contact method.
SMS help and opt-out
Reply HELP to an SMS for assistance. Reply STOP to opt out of SMS at that number. Standard opt-out keywords may also be recognized. After opt-out, the number must not be re-enabled for SMS unless the number user provides fresh consent. For assistance, contact the organization’s Oncall administrator or submit a request through the Support page.
Voice call withdrawal
Follow the opt-out option offered during an automated call, if available, remove or disable the voice contact method in Virbula Oncall, or ask the Oncall administrator to remove it. Withdrawal does not affect communications lawfully sent before it was processed.
Carrier and network limitations
Wireless carriers and communications providers are not liable for delayed or undelivered messages. Delivery is not guaranteed. Network availability, carrier filtering, device settings, invalid numbers, roaming, and provider outages can delay or prevent delivery. Customers should configure redundant channels and must not rely on SMS or voice as the sole emergency path.
5
Customer responsibility for recipients and content
The customer organization is the sender of its operational notification program and determines who receives communications. It must obtain and retain legally sufficient consent, identify itself as required, honor opt-outs, keep contact data accurate, restrict content to authorized business purposes, and comply with telecommunications, employment, and privacy requirements in every destination jurisdiction.
An administrator must not enroll another person’s phone number without documented authority and prior express consent from that person. Consent may not be bought, sold, transferred, or inferred from a general employment or software agreement where separate consent is required.
6
Third-party services and links
The website and product may interact with hosting, communications, identity, monitoring, collaboration, mobile platform, and other third-party services. Their availability, content, and independent practices are outside Virbula’s control. Use of a third-party service may be subject to separate terms selected or accepted by the customer.
7
Demo environments
Demo environments are for evaluation and may have limits different from production. Unless extended or promoted under a written agreement, a 30-day Free Demo and its data are automatically removed without backup or restoration. Do not place production, regulated, confidential, or irreplaceable data in a demo.
8
Disclaimers
To the fullest extent permitted by law, the public website, documentation, demo features, and communications enrollment tools are provided “as is” and “as available.” Virbula disclaims implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement to the extent those warranties may lawfully be disclaimed.
Virbula does not warrant that the website, a demo, or any communications network will be uninterrupted, error-free, secure against every threat, or suitable as the sole means of responding to an incident. Contracted product warranties and service levels, if any, are stated only in the applicable customer agreement.
9
Limitation of liability
To the fullest extent permitted by law, Virbula will not be liable under these website and communications terms for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, business opportunity, or data, arising from the public website, a demo request, or delay or failure of a communications carrier or customer-configured system.
Any liability relating to paid Virbula products is governed by the applicable customer agreement. Nothing in these terms excludes liability that cannot legally be excluded or limits rights that cannot legally be waived.
10
Changes to these terms
We may update these terms to reflect changes in law, carrier requirements, products, or operations. The current version will be posted here with a revised date. Material changes will receive additional notice when required.
